Judge approves settlement of Toyota

SAN FRANCISCO--a US judge granted preliminary approval on Friday, Toyota Motor Corp. $1.1 billion settlement of a class-action lawsuit brought by consumers who lost value on their cars due to sudden, unintended acceleration.

U.S. District Judge James Selna in Santa Ana, California, whose final approval of the transaction, which this week announced a hearing has been scheduled in June. It offers $500 million in cash for the plaintiff as well as installation of break systems and a customer support program worth about $600 million combined override.

"Settlement probably the interests of the members of the class better than litigation serves," wrote Selna.

Plaintiff Attorney Steve Berman said he was pleased to note the positive comments in the order Selna. Toyota spokeswoman Julie Hamp said, that the company was pleased the approval of the settlement of Selna "is available for our customers appreciate and provides an additional level of confidence in their vehicles."

Toyota and Lexus Scion vehicles sold in the United States, from the model years 1998 to 2010 fall about 16 million under the scheme. Company officials it out, that the electronic throttle control is not fault, blame was instead the ill-fitting floor mats and sticky gas pedals.

It was a disappointing holiday season for many retailers, but U.S. car dealers have been eager ringing up sales as the year wraps up.

If you hold preliminary figures for December, 2012 might be the industry's best year since the long recession and began painfully weak recovery. And 2013, design is up to even better-unless auto sales from the fiscal Cliff fall.

"I hope clearly, we get some bipartisan effort to avoid the fiscal cliff," said Ford Motor Co. Chairman Bill Ford Jr. "It is extremely important for the economy, we will work this out."

Ford Motor Co. is facing a class-action lawsuit alleging the maker’s mileage claims for two new hybrid models are “false and misleading.”

The maker has made fuel economy a major part of its advertising pitch for new products, notably including the 2013 C-Max Hybrid and Fusion Hybrid models. But its official ratings have come in for criticism, notably from such influential sources as Consumer Reports magazine.

But Ford is by no means alone. Korean siblings Kia and Hyundai recently had to roll back their own mileage numbers by as much as 6 mpg after conceding they fudged the official government testing process.

“In its advertising and marketing campaign for the vehicles, Ford claimed that the C-Max Hybrid and Fusion Hybrid achieved a class leading 47 Miles Per Gallon,” reads part of the lawsuit filed by California-based law firm McCuneWright. “These materials helped Ford achieve record sales for the first two months of C-MAX Hybrid sales, outselling its rival, hybrid sales leader Toyota, but there was a problem. These ads were false.”

McCuneWright filed its lawsuit on behalf of Richard Pitkin of Roseville, Calif., who claims he is getting just 37 mpg from the C-Max Hybrid he purchased in October. According to the mileage numbers approved by the Environmental Protection Agency – which regulates fuel economy testing – the C-Max and Fusion Hybrid models both get 47 mpg in city and highway, as well as combined, cycles.

The lawsuit follows a report by Consumer Reports that also found the C-Max averaging just 37 mpg overall, while the Fusion Hybrid averaged 39 mpg.

In a blog post, the magazine said, “These two vehicles have the largest discrepancy between our overall-mpg results and the estimates published by the EPA that we’ve seen among any current models.”

Ford has defended its mileage numbers and notes that the vehicles can be driven more aggressively in Sport mode, which will yield lower mileage.

“Early C-MAX Hybrid and Fusion Hybrid customers praise the vehicles and report a range of fuel economy figures, including some reports above 47 mpg,” Ford’s global marketing chief Jim Farley said earlier this month. “This reinforces the fact that driving styles, driving conditions, and other factors can cause mileage to vary.”

The EPA reportedly is investigating Ford’s testing procedures to ensure they comply with federal standards. A routine audit revealed that Hyundai and Kia had knowingly made procedural mistakes that resulted in a significant increase in reported mileage.

The Korean carmakers have had to reduce their rating by anywhere from one to six miles per gallon. They have also agreed to provide debit cards to owners of the affected vehicles to cover increased fuel costs. Both are also facing numerous lawsuits stemming from the mileage flap.

A number of other makers have also faced backlash over allegedly excessive mileage claims – especially with hybrid models. Consumer Reports says tests of two Toyota Prius models fell an average six to seven mpg short of EPA ratings.

Fuel economy can vary widely depending upon factors such as driver behavior, climate and even fuel quality. And hybrids are “going to be far more variable than a conventional vehicle,” according to Linc Wehrly, director of the EPA compliance division’s test center in Ann Arbor, Mich.

Part of the problem is the way the EPA test is conducted. It has a maximum speed of just 60 mph, far less than most motorists now drive on U.S. highways.

Both Toyota and Ford hybrids can operate in electric-only mode only up to 62 mph, so at speeds above that mileage may drop sharply even if vehicles like the C-Max or Prius provide accurate numbers under EPA guidelines.

The EPA has revised its testing procedures several times over the years, most recently in 2009. It plans to expand the audit that nabbed Hyundai and Kia but has not indicated whether a further revision of mileage testing procedures may be needed to give a better reflection of what consumers can expect in the real world.

Ford Motor Co. plans to invest $6.2 billion to expand its U.S. manufacturing base, a move that will help it save 3,240 existing jobs and add another 12,000 positions by 2015.

A large chunk of the investment will go into the maker’s home state of Michigan, which will see the addition of 2,350 new jobs.

“These investments, many of which are already under way, will ensure our southeast Michigan manufacturing facilities can support our aggressive growth plans,” said Jim Tetreault, the Ford vice president in charge of North American manufacturing.

The plan will cover an array of component as well as assembly plants. In the Detroit area, that includes an axle plant, a stamping facility and two assembly lines. The Michigan Assembly Plant has become the home base for an array of high-mileage models including the new Ford Focus Electric battery car.

The maker will also invest $161 million in the Flat Rock Assembly Plant to expand production of the well-received new Fusion model that is a finalist for North American Car of the Year. Until recently, there had been concerns that factory might close after Ford’s Asian affiliate, automaker Mazda, decided to pull out of the long-term joint venture and shift production of the Mazda6 sedan back to Japan.

The expansion program reflects Ford’s growth in sales and market share since the company bottomed out during the recent recession. Like a number of its domestic competitors, Ford had sharply reduced production capacity during the downturn and now needs to expand its manufacturing base to take advantage of the anticipated rise in sales.

The U.S. market is still well below its previous mid-decade peak of more than 17 million cars, trucks and crossovers but sales are expected to end 2012 at just below 14.5 million – and forecasts call for demand to start nudging 16 million over the next several years.

Key to the new program, Ford will be investing in more flexible manufacturing operations that can adapt to shifting market demand. Factories like Michigan Assembly and Flat Rock Assembly will be able to flex between different models to reflect current buying trends.

The investment program also will support the One Ford program. Increasingly, Ford is shifting to a mix of vehicles that are shared worldwide, such as the latest-generation Fiesta subcompact, rather than developing unique models for individual markets. There are, however, a few exceptions, such as the full-size F-Series pickups that are primarily targeted at the North American market.

Toyota Motor Corp. has agreed to more than 1.4 billion $ to rules that US court proceedings claiming that its vehicles suddenly and unintentionally, made accelerated public Wednesday submitted documents according to the Court.

Only two luxury models qualify so far tested: the Acura TL and the Volvo S60.

A further 117 vehicles earn the less demanding "top safety pick" honor, in some cases, because they have not yet undergone on the tough new crash-test.

General Motors will be 200 million shares of currently owned by the US Treasury which announces White House plans in the next 12 to 15 months its remaining 300 million shares selling shares to buy back.

The automaker pays $27.50 for shares which they acquire, the a premium of 7.9% over the closing price of $25.49 on December 18, 2012 - but this is set IPO also a sharp reduction from the $33 while GM in November 2010. And it means that taxpayers will lose billions from the sale.

Historical data – and recent comments by industry executives – suggest that December is traditionally a good time to buy and this year may yield some especially attractive deals.

“This will be the highest discount period,” contends Jesse Toprak, chief auto analyst for the data tracking firm TrueCar.com.

Spring is generally the strongest selling season of the year, buyers often deciding to trade in after watching the old jalopy cough and sputter through the cold. Autumn brings the traditional start of the new model-year, many buyers racing to showrooms to get the newest and hottest products.

There are, however, a number of reasons why December is a great month for those who can swing a deal on top of the rest of their Christmas and Chanukah shopping. For one thing, most shoppers are focused on other matters, whether a necktie for dad, some perfume for mom, or toys for the tots. Showrooms can be downright lonely places this time of year but dealers still have their own bills to meet – and gifts to buy – so they’re often in a mood to do what it takes to get you to buy.

This past year has been a good one for the auto industry. “The U.S. is one of the few places where the industry is making money,” notes Steve Cannon, the CEO of Mercedes-Benz U.S. After years of recession, the industry sharply cut back production capacity and with demand rebounding faster than expected there’s been less pressure to offer incentives than has historically been the case following a deep recession.

Overall, rebates and other givebacks have been falling in recent months, though that can vary, model-by-model.

Like your local dealer, manufacturers have bills to pay and factories to keep running, so they’re often in a mood to make potential buyers happy when demand might otherwise be low.

Watch TV and you’ll be barraged with ads for the various holiday specials. Regional marketing managers just might be hoping to meet their quotas. Brands might be locked into a race to see who can declare the biggest sales or market share.

But smart shoppers can improve their odds just about any day in December. There are numerous websites, such as TrueCar and KellyBlueBook, that provide pricing information. Don’t be surprised if seemingly fixed numbers, even MSRP, or the Manufacturer’s Suggested Retail Price, don’t always agree. And take so-called “invoice” prices with the proverbial grain of salt. What the deal actually pays is usually a fair bit less, says TrueCar CEO Scott Painter, because of so-called “holdbacks” and other discounts.

You’re likely to get your best deals on discontinued and leftover models, as well as vehicles such as those GM pickups that haven’t been selling as well as expected and are in over-supply.

Some experts have suggested buyers get their best deals when they’re grumpy, perhaps because sales people think the customer is more likely to walk if they don’t come up with a good deal. It certainly helps not to be overly enthusiastic and signal you’re ready to buy no matter what.

TrueCar’s Painter also stresses that while you always want to get a good price, demanding the rock-bottom number isn’t always the best deal in the long-run. A smart shopper may be willing to pay a bit more for a dealer they can trust, one that has a good reputation, the right hours, perhaps a loaner program for when your car is in the shop.

The forecast shows an another significant trend in the American market. Motorists are now an estimated 250 models of US, more than ever before.
